1. Agreement to Terms
By accessing or using the Tiny Trails application, website (tinytrailsco.com), or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service.
Tiny Trails is operated by Tiny Trails Co. (“we,” “us,” or “our”). We reserve the right to update these Terms at any time. Material changes will be communicated via the email or phone number associated with your account.
2. Eligibility
You must be at least 18 years old to use Tiny Trails. By using the Service, you represent that you are at least 18 and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Account Registration
To use certain features, you must create an account by providing a valid phone number or email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.
4. SMS / Text Messaging Program
Tiny Trails offers an SMS-based memory capture service. By opting in to receive text messages from Tiny Trails, you acknowledge and agree to the following:
Program Description
Tiny Trails sends recurring automated text messages including daily memory prompts, memory confirmations, account notifications, and service updates to the phone number you provide.
Message Frequency
Message frequency varies. You may receive up to 2 messages per day, including one daily memory prompt and occasional account or service notifications.
Message & Data Rates
Message and data rates may apply. Consult your mobile carrier for details about your text messaging plan. Tiny Trails is not responsible for any charges incurred from your carrier.
Consent Not Required for Purchase
Consent to receive text messages is not a condition of purchasing any goods or services from Tiny Trails. You may use the Service via email or the web application without opting in to SMS.
How to Opt Out
You can opt out of text messages at any time by replying STOP to any message you receive from Tiny Trails. After opting out, you will receive a single confirmation message. You may also opt out by updating your preferences in your account settings or by contacting us at hello@tinytrailsco.com.

Supported Carriers
Tiny Trails supports messaging on all major U.S. carriers. Carriers are not liable for delayed or undelivered messages. T-Mobile is not liable for delayed or undelivered messages.
5. Subscriptions & Payments
Tiny Trails offers free and paid subscription tiers. Paid subscriptions are billed in advance on a recurring basis (monthly, quarterly, or annually) depending on the plan you select. Your subscription automatically renews unless canceled at least 24 hours before the end of the current billing period.
All prices are listed in U.S. dollars. We reserve the right to change pricing with 30 days' notice. You may cancel your subscription at any time from your account settings. Refunds are handled in accordance with our refund policy.
6. Gift Subscriptions
Gift subscriptions are prepaid and non-refundable. The subscription period begins when the recipient redeems the gift code, not at the time of purchase. Gift codes do not expire. The recipient must agree to these Terms and our Privacy Policy, and separately consent to receiving text messages, when redeeming a gift.
7. Your Content
You retain full ownership of all memories, photos, videos, and other content you submit through the Service (“Your Content”). By submitting content, you grant Tiny Trails a limited, non-exclusive license to store, process, and display Your Content solely for the purpose of providing the Service to you. We will never sell, share, or use Your Content for advertising purposes.
You are solely responsible for Your Content and represent that you have all necessary rights to submit it. We reserve the right to remove content that violates these Terms.
8. Acceptable Use
You agree not to use the Service to:
Violate any applicable law or regulation; infringe on the rights of others; transmit harmful, abusive, or illegal content; attempt to gain unauthorized access to the Service or its systems; interfere with or disrupt the Service; or use the Service for any commercial purpose not expressly permitted.
9. Intellectual Property
The Tiny Trails name, logo, design system, AI-generated artwork, and all associated materials are the property of Tiny Trails Co. and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information, including information related to our SMS messaging program.
11. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
12. Limitation of Liability
To the fullest extent permitted by law, Tiny Trails Co. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of memories, or loss of revenue.
13. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately. You may export your data before termination by contacting us. We will retain your data for 30 days after account closure, after which it may be permanently deleted.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
